Launch of Trademark Dispute Resolution Portal (TDRP)

We are pleased to announce the official launch of the Trademark Dispute Resolution Portal (TDRP) by Team Track Second, a dedicated initiative designed to facilitate the efficient and structured resolution of trademark disputes through mediation.

Addressing a Critical Need

Trademark opposition and rectification proceedings in India continue to face significant delays due to procedural constraints and hearing backlogs. As per RTI responses dated 17 March 2025, there are over 3,00,000 pending matters, with several cases remaining unresolved for 10 to 15 years.

Such prolonged timelines create uncertainty for businesses, brand owners, and stakeholders, particularly those operating in fast paced markets, engaging in e commerce, or seeking international trademark protection.

About the Platform

The Trademark Dispute Resolution Portal has been developed as a neutral, confidential, and process driven platform where parties can voluntarily engage in mediation to resolve disputes. The platform is designed to encourage dialogue, reduce adversarial conflict, and enable mutually acceptable outcomes.

Key Benefits of TDRP

  • Timely Resolution: Enables faster settlement of disputes compared to traditional litigation, particularly in opposition and rectification matters handled before trademark authorities
  • Elimination of Uncertainty: Reduces prolonged ambiguity surrounding trademark rights, allowing businesses to move forward with clarity and confidence
  • Confidential Process: Ensures that sensitive business information and brand strategies remain protected throughout proceedings
  • Commercially Practical Outcomes: Focuses on solutions that align with business interests rather than purely adversarial outcomes
  • Reduced Procedural Burden: Helps parties avoid delays arising from court backlogs, particularly where proceedings are conducted before trademark registries or specialized forums
  • Preservation of Business Relationships: Encourages collaborative resolution, allowing parties to maintain professional and commercial relationships
  • Support for Innovation and Brand Protection: Ensures that opposition and rectification disputes do not hinder market entry, expansion, or brand development

Our Vision

Through TDRP, Team Track Second aims to promote a culture of efficient and solution-oriented dispute resolution within the intellectual property ecosystem. The initiative seeks to bridge the gap between legal processes and business realities by providing a practical, accessible, and effective mechanism for resolving trademark disputes.

We invite businesses, professionals, and stakeholders to explore the portal and understand how mediation can support faster and more effective dispute resolution.
