Recent Developments in Mediation: A Transformative Year 2025 for India

The year 2025 has marked a watershed moment for India’s mediation landscape, with unprecedented momentum building around the Mediation Act, 2023 and its systematic implementation across the country. The most significant development has been the launch of the historic 90-day “Mediation for the Nation” campaign by NALSA and MCPC from July 1 to September 30, 2025, under Chief Justice B.R. Gavai’s guidance. This pan-India initiative represents the largest coordinated mediation drive in Indian judicial history, targeting suitable pending cases from Taluka Courts to High Courts across matrimonial, commercial, accident claims, and other civil matters.

The Act’s provision for limited grounds for challenging settlements within strict 90-day timelines has been lauded as addressing key weaknesses in global mediation systems. The India ADR Week 2025 (September 15-19) across Bengaluru, Mumbai, and Delhi further reinforces this momentum, while technological integration advances with AI-powered mediation tools being explored following Singapore’s successful implementation. However, challenges remain, with 18 months elapsed since the Act’s enactment yet full implementation still pending, emphasizing the need for expedited rule-making and Mediation Council constitution to realize mediation’s transformative potential for India’s overburdened judicial system.
